- General
These terms and conditions (“T&Cs”) form a contract between you and Ask An Architect (“GWA Education”) that applies to your purchase of any GWA Education Content (defined below). By making a purchase, you agree to be bound by these T&Cs.
- GWA Education Content
In these T&Cs, “GWA Education Content” means any content provided to you under or in relation to the relevant course, programme or product purchased by you from GWA Education. It includes all video content, audio, photography, webinars, seminars, documentation, templates, design plans, layout plans or templates, and other educational or training content, whether provided via an online platform, website or otherwise. GWA Education is not an accredited provider of educational or training services and GWA Education Content is provided for information purposes only and will not provide to you any officially recognised or accredited qualification or certification. The GWA Education Content is provided for reference purposes and is not intended, nor should they be used, as a substitute for professional advice or judgment. GWA Education Content does not take into account your personal circumstances.
- Licence
The owner of GWA Education Content, including all intellectual property rights (including copyright) in GWA Education Content, is GWA Education and you do not acquire any ownership of, or intellectual property rights in, any GWA Education Content. When you purchase GWA Education Content through GWA Education’s website or other sales platform, GWA Education provides to you a lifetime non-exclusive non-transferable licence to access and use that GWA Education Content for your own private personal purposes, but not for any commercial purpose. Re-sale, licensing, or any copying, publishing, distributing, editing, reproduction, monetisation, or commercialisation, of any GWA Education Content is strictly prohibited unless you first obtain permission from GWA Education.
- Fees
You must pay for the relevant course, programme or product at the price displayed and via the methods provided on the relevant GWA Education website or other sales platform. Each purchase is for a single person’s use and viewing only, and may not be shared with other people or used for group viewings. By submitting an order, you agree that you are authorised and able to make the payment via the method you have selected. All prices are exclusive of GST and other sales taxes.
- Delivery
All registrants will be forwarded a confirmation email. If you do not receive an email confirmation please contact GWA Education to ensure your registration has been received. Access to GWA Education Content will not be provided until payment has been received. GWA Education Content will be made available as soon as possible once it has been produced, which is expected to be on or around 23 October 2023. GWA Education Content will be made available via the Kajabi platform (https://kajabi.com/) or such other platform or delivery methods as reasonably determined by GWA Education from time to time. GWA Education is not responsible for, and accepts no liability for, the availability of any third-party website or platform on which the GWA Education Content is hosted or distributed.
- Email subscriptions
By registering to any GWA Education program or subscribing to any GWA Education newsletter or mailing list, you agree to receive GWA Education communications regarding programs, services and newsletters. To unsubscribe to these communications in any format, you may do so at any time by writing to GWA Education at: [email protected].
- Privacy
GWA Education protects the privacy and security of information provided by you. By signing up to this activity or purchasing a product, you agree to the use of your personal information by GWA Education to process your registration, to contact you about our products and services, to disclose to third parties providing services to GWA Education, for internal purposes, and for other purposes reasonably necessary for GWA Education to deliver the GWA Education Content.
- Limitation of liability
To the maximum extent the law allows: (a) GWA Education’s maximum aggregate liability to you is limited to the amount of fees paid by you to GWA Education; and (b) GWA Education shall not be liable for any loss, injury, claim, liability or damage of any kind resulting from use of or reliance on GWA Education Content or the unavailability or interruption of any website or online platform, or any error or omission in any GWA Education Content. GWA Education’s liability to you for breach of any condition or warranty implied under any law which cannot be lawfully modified or excluded by these T&CS shall, to the extent permitted by law, be limited at GWA Education’s option to supplying the services / GWA Education Content again or paying for their re-supply.
- General
These T&Cs constitute the entire understanding between GWA Education and you in relation to GWA Education Content. If a provision of these T&Cs is invalid or unenforceable, it is severed only to the extent of the invalidity or unenforceability. These T&Cs are governed by the laws of New South Wales, Australia, and you submit to the exclusive jurisdiction of the courts of New South Wales.
